Terms and Conditions

The terms and conditions for the contest are as below: MCCS (Star Ananda) Sharad Ananda contest by dialing 505-1010-90 / 1255590 MCCS (Star Ananda) Contest Sharad Ananda (hereinafter “Contest”) is subject to the following Terms and Conditions (hereinafter “Terms”): PLEASE READ THESE TERMS CAREFULLY BEFORE YOU PARTICIPATE IN THE CONTEST. BY PROCEEDING, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT PARTICIPATE IN THE CONTEST. TERMS: This Contest is organized by MCCS (STAR Ananda), a company having its registered office at STAR News Centre, Off Dr. E Moses Road, Mahalaxmi, Mumbai 400011 and the Contest is valid during promotional Contest period only as announced in the STAR Ananda channel from time to time.

1. This Contest is valid only for existing category of active subscribers of Airtel, Touchtel (Airtel Landlines), Vodafone, Reliance, Tata, Aircel, BSNL (Mobile) for both prepaid and postpaid subscribers of Kolkata/WB circle and BSNL Landline (hereinafter referred to as “Subscribers” “caller(s)” “winner(s)” “participant(s)” or “operator(s)” as may be applicable) subject to the terms and conditions of the Contest. This Contest is valid only for the existing category of active subscribers as mentioned above, who fulfill the following criteria: i) You must be above 18 years of age. ii) You must be a citizen of India iii) You must not have any criminal record or be of an unsound mind

2. To participate: Dial 505-1010-90 from your mobile phone and 12555-90 from your BSNL Landlines.

3. System plays welcome prompt of the Durga Pooja Contest. The Contest is available in English and Bengali languages.

5. To increase their chances of winning the caller(s) have to answer the 58 questions by selecting the option, from their phone keypads. For every correct answer, caller will receive 10 points.

6. If a caller disconnects the call, then the next time they call back, the current total score of that caller will be played out at the beginning of each call.

7. If the participant drops the call after answering the nth question, the next time he/she calls back he/she will get the n+1th question.

8. If the participant drops the call without answering the nth question then when he/she calls back, he/she gets the same question.

10. This Contest is being made purely on a “best effort” basis and participation of eligible subscriber is voluntary.

11. This contest is a limited period Contest as announced in the promotional advertisements in STAR Ananda from time to time.

12. The Contest will be open from 15th Sept. 2009 at 00:00:00 hrs and will close on 29th Sept. 2009 at 23:59:59 hrs.

13. The Contest is open for residents of India only.

14. Dialing 505101090/1255590 is the only route for participation. Responses sent by any other means will be summarily rejected.

15. Neither MCCS (STAR Ananda) nor its vendors will be responsible in any manner whatsoever for failure of any backend technology of IVR application and resultant inability of a user to send in his/her entry or the loss of score arising there from and his/her inability to qualify for the prize draws because of such failure.

16. The prizes are as follows:
Daily two prizes, each worth 12500/- will be given to participants who stands at first and second position in points table on each day, during the duration of the contest.
MCCS will give these prizes to contest winners in form of ‘jewellery sets’ and will ask winners to personally collect it from their office. On successful presentation of valid ID card issued by any government office, MCCS shall handover these prizes to contest winners.

17. Any one winner cannot win the same prize more than once for the duration of the Contest.

18. In an event of a tie, MCCS (STAR Ananda) will choose the winner by means of a lucky draw.

19. MCCS (STAR Ananda) reserves the right to final decision on winners.

20. While MCCS (STAR Ananda) will make every effort to declare the results for prize draws the next day, MCCS (STAR Ananda) will not be responsible for any delay in announcing winners of the respective prize draws arising out of reasons beyond its control in the normal course of business.

21. The winners will be eligible for the prizes only after they have received intimation from MCCS (STAR Ananda). Visuals and names of the prizes depicted in our promos / communication are only indicative of the product category of prizes and in way is an indication of the brand, model or any other product attribute of the prizes. The visuals etc do not have any association to the number of prizes what so ever.

22. Employees of MCCS and its affiliates/subsidiaries, sponsors of the prizes, associated agencies, participating operators and their immediate family members and relatives are not eligible to participate in this Contest.

23. Only the winners will be informed by MCCS (STAR Ananda). The participant with maximum score is eligible for the prize and list of winners may be televised in STAR Ananda Channel or intimated to the participants/winners in any manner as MCCS (STAR Ananda) deems fit.

24. Subscriber shall directly contact vendor at 022-66630124 regarding any queries or complaints. Alternatively the subscriber can send an e-mail to tanmays@starnews.co.in . All disputes must be addressed by the subscriber in writing to MCCS (STAR Ananda) directly and the Operators shall not entertain any communication in this regard.

25. In case, contest winner is located away from MCCS office and is unable to collect the prize personally, the prize would be sent by way of a currier to the winner, at the discretion of MCCS (STAR Ananda). In case the same is returned with addressee not being present for receipt, wrong address, or any other reason Prizes must be collected within 30 days of declaration of results. Wherever possible, MCCS (STAR Ananda) may courier prizes to the winners with intimation to the winners and all prize dispatches will start only after 2 weeks of declaration of results of the draw. If the winner does not claim the prize for any reason whatsoever within 30 days of declaration of results, he/she will automatically forfeit any claim to the prize.

26. The prize(s) shall not be transferable and no such request shall be entertained by MCCS (STAR Ananda).

27. MCCS (STAR Ananda) does not take any responsibility for any errors arising out of incorrect or incomplete Contest entry.

28. The winner is solely responsible for any other expenses related to the acceptance and use of the Contest.

29. Any levies, duties, TDS and taxes, wherever applicable, shall be borne by the winner/s. If instructed by MCCS (STAR Ananda), prize must be claimed in person on production of a identity proof / address proof / PAN card / Letter of Compliance with rules and regulations The documents required to be submitted along with the claim by the winner include the above (the document list is only inclusive and not exhaustive and can change as per the requirements of Law). All cash prizes shall be paid over to the winners after deduction of applicable TDS.

30. In case false/fake identification details are submitted, the concerned person/addressee/winner shall be disqualified immediately from the Contest.

31. Any attempt by a Participant to deliberately damage any website or undermine the legitimate operation of the Scheme is a violation of Criminal and Civil Laws and should such an attempt be made, MCCS (STAR Ananda) reserves the right to seek damages from any such Participant to the fullest extent permitted by law.

32. MCCS (STAR Ananda) reserves the right to extend or to cancel, discontinue or terminate the said Contest at any time or to accept or reject any or all entries at their absolute discretion without giving any prior notice and without assigning any reason whatsoever.

33. MCCS (STAR Ananda) shall not be responsible for any direct or indirect loss or damage suffered by the winner / participant while participating in the Contest or availing the Contest including but not limited to personal injury and damage to property, whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise, whatsoever.

34. In the event of any winner choosing not to accept a prize(s) on or before the assigned date or forfeits any and/or all claims the prize(s), MCCS (STAR Ananda) shall have the absolute discretion to deal with such prize(s) as it deems fit.

35. Where a specified prize becomes unavailable, MCCS (STAR Ananda) in its absolute discretion reserves the right to substitute the said prize(s) with any other prize(s).

36. In the event of any winner choosing not to accept a prize(s) or forfeit any and/or all claims qua the prize(s), MCCS (STAR Ananda) shall have the absolute discretion deal with such prize(s).

37. The Scheme shall be governed by and construed in accordance with the laws of India. Any disputes, differences and, or, any other matters in relation to and arising out of the Scheme and, or, pertaining to the rules and regulations and, or, the Terms and Conditions shall be referred to arbitration under the Arbitration & Conciliation Act, 1996. The arbitral tribunal shall consist of a sole arbitrator who shall be appointed by MCCS (STAR Ananda). The venue of arbitration shall be Mumbai.

38. All disputes shall be subject exclusively to Delhi jurisdiction only.

39. All entries will be treated as the property of MCCS (STAR Ananda).

40. All decisions by MCCS (STAR Ananda) regarding the selection of the winners shall be final and binding.

41. MCCS (STAR Ananda) in its absolute discretion may publicize, broadcast or otherwise disclose a contestant's name, character, likeness, statements or any recording of their voice in advertising or promotional activities concerning this Contest, or generally. STAR Ananda may promote or advertise that a winner has won the Contest.

42. MCCS (STAR Ananda) in its absolute discretion reserves the right at anytime, without giving any previous notice to the participants, add, alter, modify, change or vary all or any of these Terms & Conditions, wholly or in part.

43. By participating in the Contest the participant agrees to abide with the aforesaid terms and conditions or any such terms and conditions as may be determined by MCCS (STAR Ananda).

44. The subscriber understands that the operators is neither in any way related to the organizers and administrators of the Contest, nor is it directly or indirectly involved in selection of winners.
